Medicare Advantage: review after an OMHA or Council decision

For a provider researcher who is already a party to the relevant Part C appeal. Identify the issuer of the latest decision and confirm party status before choosing the review body. Being a provider does not by itself establish a right to appeal.

After an OMHA decision: Council review

A provider that is actually a party to the Part C OMHA hearing and seeks Council review of the decision. Not confirmation of party status, a direct appeal from a health plan or IRE decision, an OMHA dismissal-review rule, Original Medicare or Part D appeal. CMS separately includes the MA organization among eligible hearing parties; this record makes no independent standing determination.

After a Council decision: federal court review

A provider that is actually a party researching judicial review after an adverse Part C Council decision or denial of Council review. Not a direct appeal from a plan or IRE, Original Medicare or Part D court review, confirmation of party status, amount eligibility, jurisdiction or sufficient court filing.

Source verification required. Filing window and submission guidance are withheld because this source changed, expired or is unavailable.

Prepare the research handoff

Retain the actual OMHA/Council decision, evidence of receipt, the party’s role and the instructions accompanying the notice. Check any applicable annual amount requirement and the receiving body’s current filing rules separately. This reference does not calculate a due date, determine court jurisdiction or submit a filing.

The time allowed to request review differs from the time the reviewing body has to act. A dismissal, overdue-case escalation or request to waive a hearing can follow a different path. No universal mailbox or court filing portal is asserted.

If your latest decision is from the Part C IRE, check the separate OMHA entry · If the health plan dismissed a reconsideration request, use the separate dismissal-review reference · Official appeal directory
